An integral component of the University of Southern Maine Libraries & Learning, the Osher Map Library and Smith Center for Cartographic Education (OML) is committed to providing access to its collections and activities in as unimpeded a manner as it can allow for as broad a public as it can reach. These Terms and Conditions of Use apply to individuals and institutions (“you”) visiting the OML website (the “site”). By accessing or using this site, you agree to the following Terms and Conditions. If you do not agree, you should exit the site and not use it further. OML reserves the right to revise these Terms and Conditions at any time by updating this posting, and also to modify or terminate any products, services, software, applications, or features on the site at any time and without notice. Please check regularly for updates. All products, services, software, applications, or features available on or through this site are subject to these Terms and Conditions.

Copyright and Intellectual Property

The University of Southern Maine (USM) and the University of Maine System are the owners of the compilation of the data, images, software, code, documentation, text, design elements, and other information contained in the site. Unless otherwise stated, OML retains all rights, copyright, and other proprietary rights in content found on this site. In some cases, copyright or other proprietary rights may be held by individuals or entities other than, or in addition to, OML. In still other cases the content may be in the public domain. The university is providing access to these materials for educational and research purposes and is not aware of any U.S. copyright protection (see Title 17 of the United States Code) or any other restrictions in the Map Collection materials.

NOTE: The written permission of the copyright owners and/or other rights holders (such as publicity and/or privacy rights) is required for distribution, reproduction, or other use of protected items beyond that allowed by fair use or other statutory exemptions. Responsibility for making an independent legal assessment of an item and securing any necessary permissions ultimately rests with persons desiring to use the item.

License

OML provides free and open access to digital images of works in its collection that are in the public domain, as well as to certain other materials, including the descriptive information which accompanies those images. OML makes these materials available under a Creative Commons BY-NC-SA (Attribution-NonCommercial-ShareAlike) license BY-NC-SA.

That is, users are free to share and to remix works on this site as long as:

1) you give full attribution to OML as the source of the material (see below) without suggestion of any endorsement by OML;

2) you may not use these materials for commercial purposes; and

3) you may remix these materials in any way (for example, incorporated into a GIS or a work of art) and further redistributed, but only under the same BY-NC-SA license.

Any other use, including commercial usage, requires the prior approval of the Executive Director.

Attributing Materials to OML

When reused, general materials from the OML website should be clearly accompanied by the website’s base URL: www.oshermaps.org.

Images should be clearly accompanied by the image URI, as specified on the image-view page, in the form www.oshermaps.org/maps/id.xxxx where id.xxxx is the unique image identifier.

Good practice requires, however, that you also provide information about the material and its authors, as well as its sources. It is therefore requested that citations to pages on this site include:

  • the author and date (these are specified on the front page of exhibitions, lesson plans, etc.);
  • page title;
  • the names of OML and USM;
  • the full URL; and
  • the date accessed.

USM and OML are committed to protecting the privacy of visitors to its website. We do not collect any information about you unless you specifically contact OML staff.

OML does not endorse any third-party sites or any offers available through any such sites. OML has no responsibility for any transactions and communications between you and any third party, including but not limited to any personal information you may choose to provide to any third party.

Applicable Law and Jurisdiction

These Terms of Use and any amendments or revisions shall be governed by the laws of the State of Maine, without regard to its conflict of laws principles. Any case, controversy, suit, action, or proceeding arising out of, in connection with, or related to these Terms of Use shall be brought in the State or Federal Courts located in the State of Maine.
